General Terms and Conditions of Sale

1) Soggetti - Disposizioni generali:

Le seguenti condizioni di vendita sono valide esclusivamente tra la società CRISWEED di Bellesia Alisia – Ditta individuale - Sede Legale in Via Remo Sogari n. 1, 41012 Carpi (MO) - P. Iva n. 04072660360 – C.F: BLLLSA98H51B819B e qualsiasi persona fisica che agisce per scopi estranei all'attività imprenditoriale o professionale eventualmente svolta. Le seguenti condizioni disciplinano gli acquisti di prodotti effettuati online sul sito CRISWEED.IT. La navigazione e la trasmissione di un ordine di acquisto sul sito comportano l'accettazione delle Condizioni e delle Politiche di protezione dei dati adottate dal sito stesso ivi indicate. Le presenti condizioni di vendita si applicano alla vendita di prodotti con esclusivo riferimento agli acquisti effettuati sul sito Crisweed.it conformemente alle disposizioni di Legge e per quanto previsto ed indicato dal Codice del Consumo (D.Lgs. 206/2005) così come modificato dal D.Lgs. 21/2014, oltre a quelle di cui al D.Lgs. 70/2003 (Commercio elettronico), nonché alle previsioni del Codice Civile, in quanto applicabili. Si invita l'utente a prendere contezza delle presenti Condizioni Generali di vendita i cui termini Crisweed si riserva di modificare unilateralmente e senza alcun preavviso.

2) Informazioni precontrattuali per il Cliente:

Prior to the conclusion of the contract, the Customer reviews the characteristics of the individual products, listed in the relevant description sheets.
The Customer is also informed, in accordance with the provisions of Article 54 of the Consumer Code, specifically about the following:
– Identity of the professional, as indicated in the previous point, as well as their contact information : (3453717126, “info@crisweed.it”)
– Total price of products (including taxes) as well as the cost of shipping;
– Payment methods available to the Customer;
– Estimated time for fulfillment and delivery of ordered products;
– Ways, terms and procedures related to the exercise of the right of withdrawal; procedure and costs for any return of products;
– Legal guarantee of conformity regime

3) Disponibilità dei prodotti

The Customer may only purchase products currently in the electronic catalog visible online. Should the request formulated through an online order exceed the quantity available for a given item, Criswwed will accept the purchase limited to what is actually available in its virtual warehouse, however, giving timely notice to the Customer who may, if not interested in purchasing the smaller quantity, cancel the order at no cost to him/her.
It will also be the responsibility of Customer Service to let the customer know (via telephone or e-mail) whether or not the products ordered, and at the time of the order not in stock, will be available in the future. Items selected from those in the virtual catalog may be purchased under the following conditions: – unless otherwise indicated, product prices are to be understood to include taxes.
Images of products on the site are indicative and not binding.

4) Accettazione dell'ordine / Conclusione del contratto
The purchase of what is requested will be completed through the following steps: – to send the order put the products in the shopping cart and confirm the purchase. The shopping cart shows the images of each product and its price, the accepted means of payment and the relevant shipping costs and means of delivery.
By sending the order, the customer transmits to Crisweed a proposal to purchase the selected product or products. Sending the purchase order implies consent (pursuant to art. 10 D.L. 185/1999) to receive subsequent communications from Crisweed aimed exclusively at the conclusion and execution of the sales contract. Crisweed reserves the right not to accept incomplete or not duly completed orders.
Crisweed confirms with an e-mail message the receipt of the order transmitted by the customer, with the assignment of an “Order Number” that must be indicated in any further communication. Crisweed will verify the actual availability in stock of the products requested and will communicate by telephone or e-mail, to the number or e-mail address indicated by the customer, any non-acceptance of the order. The fulfillment of the order is equivalent to confirmation and acceptance of the same. Crisweed will then activate the shipping procedure at the operator and courier in charge in order to perform the delivery to the address indicated. If the shipping costs were different from those indicated, before processing the order, Crisweed will contact the Customer by informing him and, only after receiving his consent, will provide for the fulfillment of the order. Payment by the Customer will be made using the methods indicated and chosen online at the time of purchase. The goods can “be shipped to a different address from the billing address if in the order form (in the ‘Notes’ section) and” was specified a different place of destination of the goods. The transfer of the goods shall be deemed perfected only upon shipment of the same.
5) Modalità di pagamento accettate

Payment for orders can be made in three ways, which provide for the full balance of the order in advance.

1) Bank transfer to Hype Bank s.p.a. Bank account no. EM002460847, IBAN: IT73P36772223000EM002460847 made out to Bellesia Alisia.
At the order confirmation, you will be able to see the details to make the payment. Orders are shipped upon actual crediting of the transfer. If the transfer is not made within 3 working days from the order confirmation, the order will be cancelled. The transfer must necessarily be anticipated by the receipt of the accounting as an attachment to the email address info@crisweeed.it in the subject line of which the order number must be specified.

2) Credit card, using the PayPal system, which will check the validity of credit cards and ensure maximum security for each transaction.

6) Modalità e spese di consegna

Crisweed will activate the shipping procedure as quickly as possible and in any case within 24/48 hours from the confirmation of the completion of the purchase process. Crisweed ships within Italy.
All product delivery costs are borne by the customer at the cost indicated at the time of order completion. Deliveries are normally made by UPS Courier or Poste Italiane, subject to delivery of products ordered by a different courier than the one(s) mentioned above. Delivery will take place no later than 3 days from the date of delivery of the product to the Courier in charge and receipt of an email containing the tracking information of the shipment. Any delay in delivery beyond the term of 7 days will entitle the Customer to refuse the same with the right to full reimbursement of the sums paid and without any other or different costs borne by the Customer.
Upon home delivery, the customer is required to verify that: the number of packages delivered corresponds to that indicated in the accompanying document; the packaging is intact, not damaged or wet or otherwise altered.
The invoice, contained within the packaging must be kept. The mismatch in the number of packages, as well as loss or any damage to the packaging, must be immediately reported to the carrier, the goods, if picked up, must be picked up “with reserve”.

7) Diritto di recesso e condizioni per il suo esercizio
Pursuant to art. 57 Legislative Decree 206/2005 (Consumer Code) and subsequent amendments, if the customer is a consumer (i.e. a natural person who buys goods for purposes not related to his professional activity, or does not make the purchase by indicating in the order form a reference to VAT), has the right to withdraw from the purchase contract for any reason, without explanation and without penalty (excluding shipping costs).

This right may be exercised upon receipt of the order confirmation sent by Crisweed no later than fourteen (14) days after receipt of the products at the address indicated for delivery. Full proof of receipt of the goods shall be the date indicated by the tracking of the shipment.

The customer may exercise the right of withdrawal through appropriate communication to be sent to the e-mail address“info@crisweed.it”including: indication of the recipient’s details, order number, date of receipt, tax code, receiving address and method of crediting the amount if different from that used in the payment.

If the product has already been delivered, the customer is required to return it to Crisweed, having in mind the following conditions: the deadline for the return of the product is fourteen (14) days from the notice of withdrawal (in the case of reshipment by the customer, the customer must provide proof of shipment). For the purposes of the deadline, the product is deemed to be returned when it is delivered to the post office and/or accepting carrier.

Where there has been delivery of the product, the substantial integrity of the product itself to be returned is a necessary and indispensable condition for the exercise of the right of withdrawal. The customer must ship the product properly wrapped and packaged. Crisweed will not accept returns damaged or with undamaged packaging. Only products in normal condition, still in their original packaging, stored and handled with normal diligence will be accepted upon verification. Under no circumstances will returns be accepted and refunds issued on products damaged by the customer due to inexperience.

Crisweed is not liable in any way for damage or theft/loss of goods returned in uninsured shipments. The risks of transportation for the return of products are fully borne by the customer. The customer must place a copy of the delivery document received inside the packing box.

The cost of returning the goods to Crisweed is the responsibility of the customer. If the customer exercises the right of withdrawal in accordance with the provisions set forth in these terms of sale, Criswed will refund the amounts paid by the customer on the same means of payment used by the customer for the original transaction (bank transfer, credit card, Paypal circuit ), unless otherwise indicated by the customer.

In the event of withdrawal for an order that was shipped free of charge due to promotions and/or exceeding the value threshold, the customer will be required to repay the cost of outward transportation at the rates indicated on our “shipping” web page in addition to the cost of return as these are transportation services however provided and paid for by the seller and which if not repaid would represent a loss.

The refund will be made, within the stated period of fourteen (14) days from the date Crisweed has received in its warehouses the returned product in accordance with the above.

As provided for in Article 59 of the Consumer Code as amended, the right of withdrawal regulated by these terms and conditions of sale, does not apply to products made to measure or clearly personalized or which are likely, by their nature, to deteriorate or alter rapidly.

8) Garanzia commerciale

All products for sale on the CRISWEED.IT Site, are covered by a commercial warranty indicated by the individual manufacturer and stated in the technical-descriptive data sheet of each product. If the purchaser has entered into the contract as a consumer (i.e., an individual who purchases the goods for purposes not related to his or her professional activity, i.e., does not make the purchase by indicating a VAT number on the order form), this warranty is valid provided that the defect manifests itself within 24 months from the date of delivery of the products; that the customer makes a formal complaint regarding the defects within a maximum of 2 months from the date on which the defect was recognized by the customer. Consumables are excluded from the 24 months.

In case of non-conformity, the purchaser who has entered into the contract as a consumer shall have the right to obtain the restoration of conformity of the products without cost, by repair or replacement, or to obtain an appropriate price reduction or termination of the contract with respect to the disputed goods and the consequent refund of the price.

All return costs for defective products will be borne by the Crisweed seller.

9) Rinuncia

Any right of the customer to damages or compensation, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or property caused by goods purchased from Crisweed is excluded.

10) Reclami

11) Legge applicabile e Foro competente

The contract of sale between the customer and Crisweed is concluded in Italy and governed by and construed in accordance with Italian Law. In particular, if the purchaser qualifies as a consumer, any disputes shall be resolved by the court having jurisdiction over the purchaser’s place of domicile or residence under the applicable Law.

12) Rinvio alle disposizioni del Codice del Consumo

For anything not expressly regulated by these Conditions of Sale, the provisions of the current text of Legislative Decree. 206/2005 as amended by Legislative Decree. 21/2014, in addition to those under Leg. 70/2003 (Electronic Commerce), as well as the provisions of the Civil Code, as applicable.
